It observed that automatic citizenship was granted to children of U.S. citizen fathers and noncitizen mothers by an 1855 act of Congress, but the reverse situation was only addressed, non-retroactively, in 1934. In 1971, the Court encountered a similar situation in Rogers v. Bellei, where the individual in question was born after 1934 and so was granted automatic U.S. citizenship, though subject to residence requirements and was subject to expatriation. The Court “appeared to assume or imply that such persons became citizens at birth by way of naturalization”. Court of Appeals for the Tenth Circuit noted in Zimmer v. Acheson that “here are only two classes of citizens of the United States, native-born citizens and naturalized citizens”, quoting a dictum by Justice Gray from Elk v. Wilkins and United States v. In more than 15 years of polling by Pew Research Center, half of Americans who trace their roots to Spanish-speaking Latin America and Spain have consistently said they have no preference for either Hispanic or Latino as a term to describe the group. And when one term is chosen over another, the term Hispanic has been preferred to Latino. Importantly, the same surveys show, country of origin labels are preferred to these pan-ethnic terms among the population they are meant to describe. While originally the term referred primarily to the Hispanos of New Mexico within the United States, today, organizations in the country use the term as a broad catchall to refer to persons with a historical and cultural relationship with Spain regardless of race and ethnicity. Today is Latina Equal Pay Day, the day in 2018 when Hispanic women in the United States have to work to earn as much as white men in the United States earned in 2017 alone. That gap is greater than for black women, who earn 39% less than white men, according to an analysis of U.S. Census Bureau data, and greater than for Native American women, who earn 42% less than white men. Latina women earn 46% less than white men and 31% less than white women, the worst gender wage gap for any group of minority women, according to 2019 data. The U.S. needs immigration to supplement its labor pool if policy makers desire higher economic potential over time. While the immigrant share of the U.S. population is just below historic highs set more than a century ago, some estimates of unauthorized immigration are declining. Federal Reserve Chairman Jerome Powell told lawmakers last month that immigration is a “key input” to higher rates of growth. The number of Hispanic women with college degrees has doubled in the past 10 years to 4.8 million, increasing their ability to engage with the workforce. Enrollment data shows a significant portion of Latinas remain enrolled in school after age 21, suggesting they are pursuing graduate degrees, or juggling school with work and family support.

Regardless of their level of education, white men benefit from approximately similar wage premiums—just above 20 percent. Alternatively, Hispanic women who receive a high school diploma experience a wage gap that is about 10 log points lower than Hispanic women who dropped out before graduating high school. In contrast, the benefit of some college is marginal in closing the wage gap, and the benefits of a bachelor’s degree are even smaller.
